Proposed Constitutional Amendments
The NDSBA Board of Directors is proposing amendments to the NDSBA Constitution, which was last revised in 2013. The proposed changes are intended to clarify and strengthen the provisions governing the structure and continuity of the Board of Directors, particularly in situations where a director or officer ceases to serve on their local school board.
The most significant proposed amendments are to Article V (Directors). Under the current constitution, officers and directors may remain on the NDSBA Board until the next annual election, even if they are no longer serving on their local school board. The proposed revisions would instead create an immediate vacancy in the event a board member is no longer eligible. The Board would be required to fill the vacancy within 90 days, unless the vacancy occurs after July 1 in the final year of the term—at which point the Board may choose to leave the position vacant until the next annual meeting. The past president may continue to serve regardless of board membership status.
In addition to these substantive changes, the proposed amendments also include minor grammatical revisions throughout the document to improve clarity and consistency.
In accordance with Article VIII of the Constitution, the proposed amendments will be presented to the Delegate Assembly for a vote at the Annual Convention in October. To be adopted, the amendments must receive approval from two-thirds of the delegates present and voting.
